Terms of Service

These Terms of Service ("Terms") govern your access to and use of the MailFlow product and related services ("Service") provided by MailFlow Labs Inc. ("MailFlow," "we," "us"). By creating an account or using the Service, you agree to be bound by these Terms.
1. Account
You must provide accurate registration information and keep it up to date. You are responsible for safeguarding your password and any actions taken under your account. You must notify us promptly of any unauthorized access.
2. Acceptable use
You agree to use the Service in compliance with all applicable laws and our Acceptable Use Policy. You may not use the Service to send unsolicited bulk email, harass recipients, distribute malware, or impersonate any person or entity.
3. Subscriptions and billing
Paid plans bill in advance on a monthly or annual cycle through Stripe. Fees are non-refundable except where required by law. You may cancel at any time from the billing portal; cancellations take effect at the end of the current billing period.
4. Trial
New workspaces may receive a 14-day trial of paid features. At trial end the workspace downgrades to the Free plan unless you upgrade.
5. Your content
You retain all rights to content you upload (lead lists, sequences, replies). You grant MailFlow a limited license to host, process and transmit that content solely to provide the Service. You are responsible for the accuracy and lawful collection of any personal data you upload.
6. SMTP and IMAP credentials
When you connect an email account, you provide application credentials (typically an App Password). MailFlow encrypts these credentials at rest with AES-256-GCM and uses them solely to send and receive mail on your behalf. You may revoke a connection at any time; we will purge the encrypted credential within 30 days.
7. Service availability
We strive for high availability but do not guarantee that the Service will be uninterrupted or error-free. Scheduled maintenance windows are announced in advance where possible. The Scale plan includes a 99.9% uptime SLA detailed in your order form.
8. Termination
We may suspend or terminate your account if you breach these Terms, our Acceptable Use Policy, or any applicable law. You may terminate at any time. On termination we will delete your data within 30 days unless legal hold requires longer retention.
9. Disclaimers and limitation of liability
The Service is provided "as is" without warranty of any kind. To the maximum extent permitted by law, MailFlow's aggregate liability is limited to the fees you paid in the 12 months preceding the claim.
10. Governing law
These Terms are governed by the laws of the State of Delaware, without regard to conflict- of-law principles. Disputes will be resolved in the state or federal courts located in Delaware.
11. Changes
We may update these Terms from time to time. Material changes will be communicated by email and via in-product notification at least 30 days before they take effect.
